SMS Notification Terms of Service
Winter Express Logistics LLC — Effective Date: January 1, 2026
1. Service Description
Winter Express Logistics LLC (“Company,” “we,” or “us”) provides an optional SMS (text message) notification service for our Delivery Associates (DAs) and employees. This service delivers important work-related information, including:
- Schedule changes and shift reminders
- Attendance and punctuality notifications (to support compliance with the Company's Attendance and Punctuality Policy)
- Station closure or operational disruption updates
- Safety alerts, uniform requirements, and delivery instructions
- Scorecard updates and other important company announcements
Participation is completely voluntary. This SMS service is not a substitute for required call-in or in-person check-in procedures outlined in the Attendance and Punctuality Policy. Employees must still report absences or tardiness according to existing policy.
2. Opt-In and Consent
By affirmatively consenting through the Driver Card portal, you agree to receive SMS messages from Winter Express Logistics LLC. You must provide your own mobile phone number. We will not add numbers without explicit consent.
3. Message Frequency
Message frequency varies and depends on operational needs. If you have questions about your text plan or data plan, it is best to contact your wireless provider.
4. Fees and Charges
Message and data rates may apply. Your mobile carrier may charge you for text messages sent or received. Winter Express Logistics LLC does not charge any additional fees for this service and will never bill you directly for SMS messages. Please check with your mobile carrier for details on your plan.
5. Opt-Out Instructions
You may opt out of the SMS service at any time by replying STOP to any message we send. After opting out, you will receive one final confirmation message and will no longer receive SMS notifications. Opting out does not affect your employment status or at-will employment relationship with the Company.

7. Privacy
Your mobile number and any information collected through this SMS service will be used only for sending work-related notifications. We do not sell or share your mobile number with third parties except as required by law or to operate the service (e.g., through our SMS platform provider). Please review our Privacy Policy.
8. Changes to Terms
We may update these SMS Terms of Service from time to time. Continued receipt of messages after changes are posted constitutes your acceptance of the updated terms. We will notify you of material changes via SMS or other available channels.
9. Termination or Suspension
We reserve the right to suspend or terminate the SMS service or your participation at any time, for any reason, without notice.
10. General Provisions
- This SMS service is provided “as is” without warranties of any kind.
- Nothing in these terms alters your at-will employment relationship with Winter Express Logistics LLC or creates any additional contractual rights.
- These terms are governed by the laws of the State of Tennessee.
- In the event of any conflict between these SMS Terms and the Company's Employee Handbook or other policies, the Employee Handbook and policies control.
By participating in the SMS notification service, you acknowledge that you have read, understood, and agree to these Terms of Service.
